EPO Opens New Path for Lawyers: Join Associations of Representatives
The European Patent Office (EPO) has opened a new avenue for lawyers. As of October 1, 2025, lawyers can now join associations of representatives, previously restricted due to individual authorisation requirements. This move is part of the EPO's ongoing simplification and digitalisation efforts under its Strategic Plan 2028.
Previously, representation in EPO proceedings was limited to professional representatives, associations, or lawyers. Now, lawyers can create and join associations, gaining equal footing with professional representatives. This change allows lawyers to participate in over 600,000 ongoing proceedings alongside patent attorneys and other lawyers.
MyEPO, the EPO's self-service platform, now facilitates the creation and administration of these associations. This shift is set to streamline the representation process, as membership in an association grants representation authority without the need for individual authorisation for each member.
The EPO's decision to allow lawyers to join associations of representatives is a significant step in its drive towards simplification and digitalisation. This change expands the pool of professionals eligible to represent clients in EPO proceedings, potentially enhancing the efficiency and accessibility of the patent system.
