Nintendo Wins Lawsuit Against Modded Hardware

In a significant move, Nintendo has secured a victory against Modded Hardware, a company specialising in modifying Nintendo Switch consoles. The court ruled that Modded Hardware's activities were illegal, specifically citing the sale of the MIG Switch. This device mimics a Nintendo Switch cartridge and allows the playing of pirated game copies. As a result, Modded Hardware has been ordered to pay a $2 million fine and its manager, Ryan Deiley, has been permanently banned from engaging in activities such as selling illegal services and products related to Nintendo Switch consoles.

Deiley, the manager of Modded Hardware, had defended his activities as not violating the law and as 'fair use.' However, the court did not accept these arguments. In addition to the fine and ban, the court also mandated Deiley to destroy all devices and tools used for modding.

This is not the first time Nintendo has taken legal action against violators of its intellectual property. The company is known for being one of the most aggressive protectors of intellectual property in the video game industry.
