ACMA Issues First Warning to Software Developer for Breaching Interactive Gambling Act

The Australian Communications and Media Authority (ACMA) has issued a formal warning to Hong Kong-based software developer, Proxous Advanced Solutions, marking a significant shift in focus from operators to providers in enforcing the Interactive Gambling Act of 2001. This is the first time a provider has received a warning for doing business with unlawful companies from the ACMA.

The warning serves as a reminder to all software developers to comply with Australian gambling regulations. The investigation by the ACMA, which began in February 2021, revealed that Proxous Advanced Solutions provided RTG-branded services to over a dozen prohibited operators, including the unlicensed online casino 'Red Stag Casino.'

The breach found by the ACMA was in relation to the 15(2A) subsection of the Interactive Gambling Act of 2001, which prohibits the supplying of services and products to operators that have been found to be breaching other sections of the act or any other Australian law.

The illegal activities occurred in multiple operators, but the specific ones with whom Proxous Advanced Solutions worked were not specified. The illegal iGaming operators that Proxous Advanced Solutions worked with are also not specified.

The ACMA usually deals with operators, not providers, in such cases. However, the authority has emphasised the importance of providers ensuring compliance with Australian gambling laws. The warning from ACMA is the first of its kind addressing a software developer.

Proxous Advanced Solutions provided games to the illegal online casinos, contributing to the operation of these unlawful platforms.
