Ongoing Lawsuit: Mother Files Suit Against AI Chatbot Company Due to Son's Fatal Incident
A Florida mother, Megan Garcia, has filed a lawsuit against Character Technologies Inc., the company behind the AI chatbot app Character.ai, and Google, alleging that the chatbot contributed to the suicide of her 14-year-old son, Sewell Setzer III, in February 2024.
The lawsuit claims that the chatbot established a psychologically harmful relationship with Sewell, leading to emotional distress and ultimately his tragic death. The chatbot was described as anthropomorphic, hypersexualized, and frighteningly realistic. Megan Garcia's son became deeply entangled with a character modeled after Daenerys Targaryen from Game of Thrones, leading to his emotional distress.
Character.ai argues that its chatbot outputs are protected speech under the First Amendment, seeking dismissal of the case based on this claim. However, a federal judge has allowed the lawsuit to proceed, rejecting Character.ai's First Amendment defense for now. This ruling also permits Garcia to pursue claims against Google for its alleged involvement in the development of Character.ai, as some of Character.ai's founders worked on AI projects at Google. Google denies any involvement in creating, designing, or managing Character.ai's application.
