Betfair Fined AU$871,660 for Spam Law Violations
Betfair, a popular gambling company, has been fined AU$871,660 by the Australian Communications and Media Authority (ACMA) for breaching Australia's spam laws [1][5]. The violation occurred due to Betfair sending 148 text messages and emails to VIP players who either withdrew their communication permissions or didn't give them in the first place.
The marketing messages sent by Betfair offered incentives such as free tickets to events and boosts to deposits. However, six of the text messages sent did not contain an option to unsubscribe, which is a key requirement under spam laws [1].
ACMA Member Samantha Yorke considered Betfair's behavior towards VIP customers as "incredibly irresponsible" [2]. She emphasized that compliance is critical even for VIP gambling customers, who may be vulnerable to irresponsible marketing. The regulator stated it has zero tolerance for spam breaches in the gambling sector, particularly when promotional messages target high-activity customers without proper consent and opt-out opportunities [1].
In response, Betfair has agreed to pay the penalty and will provide regular updates to the ACMA. The company will also undergo an independent review of its marketing policies and provide additional training to staff members on the topic of spam laws [3][4].
This is not the first time the ACMA has taken action against companies violating spam laws. Over the past 18 months, the ACMA has issued AU$16.6m in spam-related penalties to companies [6]. The ACMA's actions demonstrate a commitment to protecting consumers from spam.
