In a company-wide note, a16z GP David Ulevitch defended the hiring, acknowledging Penny's commendable act during a challenging situation. He was acquitted of all charges and a16z maintains their policy of evaluating individuals beyond their worst moments.

The controversial incident unfolded in 2023 when Penny encountered 30-year-old Jordan Neely in a New York City subway. Neely was behaving erratically, and Penny chose to apply a chokehold that lasted for six minutes. Neely passed away due to neck compression.
Penny was subsequently arrested, charged with negligent homicide, and manslaughter. At the trial, the defense introduced a forensic pathologist who suggested Neely's death was not due to the chokehold but rather a mix of factors including schizophrenia, synthetic marijuana, and sickle cell trait. However, the original autopsy refuted these claims, leaving no alternative causes of Neely's death. A jury ultimately acquitted Penny of negligent homicide.
