The works council, while independently processing data, remains responsible to the employer for GDPR compliance. To ensure this, a mutual agreement is recommended to manage their obligations and support each other.

This agreement should cover creating a deletion concept for unused data and documenting internal data protection processes. The works council should also be aware of its indirect information obligations towards employees and applicants under the GDPR.

To strengthen data protection and employee trust, the works council should cooperate closely with the employer. It must independently organize data handling, adhering to data security measures such as controlling office access and secure document shredding.
